1. Acceptance of Terms

By accessing the Site, submitting a contact or estimate form, or entering into a service agreement with us, you confirm that you are at least 18 years old and have the legal authority to agree to these Terms on your own behalf or on behalf of the entity you represent. If you are acting on behalf of a business or property owner, you represent that you have the authority to bind that party.

2. Description of Services

North Miami Beach Epoxy Flooring & Concrete Polishing provides concrete flooring installation, coating, resurfacing, polishing, sealing, and related services for residential and commercial properties. Services are provided in the North Miami Beach, Florida area and surrounding communities.

All services are subject to a written estimate and a signed service agreement. We reserve the right to decline any project at our discretion.

3. Estimates and Pricing

All estimates are provided in writing following an in-person or on-site assessment of the project location. Phone or online estimates are general in nature and do not constitute a binding price. The written estimate reflects the scope of work as assessed at the time of the visit.

Prices in the written estimate are valid for 30 days from the date issued. If site conditions change, if the project scope is modified, or if additional work is required due to issues discovered during the job (such as hidden concrete damage or elevated moisture levels), we will notify you in writing before proceeding with any work beyond the original estimate.

Estimates do not include the cost of permits unless explicitly stated. If a permit is required for your project, permit fees are your responsibility unless otherwise agreed in writing.

4. Scheduling and Cancellation

Project start dates are confirmed in writing at the time of scheduling. We will make reasonable efforts to begin and complete work on the agreed schedule. Delays caused by weather, permit approvals, material availability, or conditions outside our control do not constitute a breach of agreement, and we will communicate any delays to you as soon as practicable.

If you need to reschedule, please notify us at least 48 hours before the scheduled start date. Rescheduling on shorter notice may result in a rescheduling fee, which will be disclosed to you at the time.

If you cancel a project after a written agreement has been signed and materials have been ordered, you may be responsible for the cost of materials already purchased for your job. We will provide documentation of any such costs.

5. Payment Terms

Payment terms are stated in the written service agreement. In general, we require a deposit before scheduling your project, with the balance due upon completion. Accepted payment methods will be specified in your agreement.

Final payment is due on the day the work is completed and the walkthrough is done, unless otherwise agreed in writing. Invoices not paid within the agreed timeframe may be subject to a late fee as specified in the agreement.

We reserve the right to withhold warranty coverage and to pursue collection of unpaid balances through all available legal means if payment is not received as agreed.

6. Your Responsibilities

To allow us to perform the work properly, you agree to:

• Clear the work area of all vehicles, equipment, furniture, and stored items before the scheduled start date
• Provide reasonable access to the property and utilities (water, electricity) needed to complete the work
• Disclose any known conditions that may affect the project, including previous coatings, drainage issues, or recent flooding
• Ensure that any required HOA approvals or permits are obtained before work begins, unless we have agreed in writing to handle permits on your behalf

Failure to meet these responsibilities may delay the project or affect the final result. Additional charges may apply if the crew arrives to a site that is not ready as agreed.

7. Warranty Disclaimer

Any warranty we provide is stated in your written service agreement. Outside of what is expressly stated there, all services are provided "as is." We do not make implied warranties of merchantability or fitness for a particular purpose beyond what is in the written agreement.

Warranty coverage does not apply to damage caused by:

• Improper maintenance or use of cleaning products not recommended for the coating type
• Physical damage from sharp objects, heavy impacts, or vehicle tires on freshly cured surfaces
• Structural movement, settling, or cracking of the underlying concrete slab
• Water intrusion or flooding not attributable to the coating installation
• Changes or modifications to the floor by anyone other than our crew

The Site itself is provided for informational purposes only. Content on the Site does not constitute professional advice and should not be relied upon as a substitute for a formal written estimate or agreement.

8. Limitation of Liability

To the fullest extent permitted by applicable law, North Miami Beach Epoxy Flooring & Concrete Polishing and its owners, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from the use of the Site or from any service provided, including but not limited to lost profits, business interruption, or property damage not directly caused by our negligence.

Our total liability for any claim related to services provided shall not exceed the amount actually paid by you for the specific service giving rise to the claim. Nothing in these Terms limits liability for personal injury or property damage caused by our proven negligence.

9. Dispute Resolution

If a dispute arises between you and North Miami Beach Epoxy Flooring & Concrete Polishing, we ask that you contact us first to try to resolve it informally. Most issues can be addressed quickly when both parties communicate directly.

If informal resolution is not possible within 30 days, the parties agree to attempt resolution through mediation before pursuing any other legal remedy. Mediation shall take place in Miami-Dade County, Florida.

If mediation is unsuccessful, disputes shall be resolved in a court of competent jurisdiction in Miami-Dade County, Florida. You agree to submit to the personal jurisdiction of that court for these purposes.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

11. Site Use

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that could damage, disable, or impair its performance
• Attempt to gain unauthorized access to any part of the Site or its related systems
• Transmit any harmful, deceptive, or unlawful content through forms or other Site features
• Reproduce, distribute, or create derivative works from Site content without our written permission

12. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the effective date at the top of this page. Continued use of the Site or engagement of our services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
